Tiny Screenfuls: How Can You Steal Free WiFi?

I asked the same question that Josh Bancroft of Tiny Screenfuls asked when I saw news of the poor schlub who get arrested for filching a signal from a coffee shop. On one hand I'm glad this sort of thing is being looked at seriously, on the other hand we might have a semantic problem. How can you steal what is advertised as free. I know, free for the customers of the establishment, yeah, sure, but where does that start and stop.

Let's say the coffee shop has an outdoor sitting area and customers are using the signal there. Is someone sitting just outside that fence in their car, who just bought a cup of coffee stealing the signal or no.

What about the guy/gal strolling down a walking mall who stops to use his/her WiFi equipped cellphone?
